I. Scope

1. These terms and conditions apply to contracts for the rental of hotel rooms for accommodation as well as all other services and deliveries provided to the customer by the company “Alte Schlossbrauerei”. The owner of “Alte Schlossbrauerei” is Martina Heyden-Smentek.
2. Subletting or further letting of the rooms provided, as well as their use for purposes other than accommodation or overnight stays, requires the prior written consent of the owner.
3. The customer's terms and conditions only apply if this has been expressly agreed in writing beforehand.

II. The Contract

1. The accommodation contract (rental contract) or the contract for an event is concluded as soon as the hotel room or the event is booked and the booking confirmation or the offer for the planned event, signed by the guest, is received by the Alte Schlossbrauerei by fax, email or post within the period specified in the order confirmation or offer, or, if a written confirmation was no longer possible due to time constraints, has been provided.
2. The conclusion of a guest accommodation agreement (rental agreement) or an event contract obligates both parties to fulfill the contract, regardless of its duration. For contracts concluded more than 40 days prior to arrival, each party is entitled to withdraw from the contract free of charge by unilateral declaration without stating reasons, provided that this declaration is received by the other party no later than 40 calendar days before the agreed arrival/event date. If the agreements cover more than 30 overnight stays per booking, the aforementioned period is extended by 30 days. For events, the 40-day period applies.
3. Tentative or option dates are binding for both contracting parties. The owner of the Alte Schlossbrauerei reserves the right to rent the reserved rooms and function rooms to other parties after the tentative or option dates have expired.
4. The contracting parties are the owner of the Alte Schlossbrauerei (Old Castle Brewery) and the customer. If a third party has made the booking for the customer, that third party is jointly and severally liable to the owner of the Alte Schlossbrauerei together with the customer for all obligations arising from the hotel accommodation contract, provided that the owner of the Alte Schlossbrauerei has received a corresponding declaration from the third party.
5. The owner of the Alte Schlossbrauerei (Old Castle Brewery) is liable for her obligations under the contract. In areas not typical of the performance of the contract, liability is limited to intent and gross negligence on the part of the owner of the Alte Schlossbrauerei.
6. The limitation period for all claims by the customer is six months.
7. This limitation of liability and short limitation period also apply in favor of the owner of the Alte Schlossbrauerei in the event of breach of obligations during contract negotiations and positive breach of contract.

III. Arrival and Departure

1. Unless otherwise agreed in writing, reserved rooms are available to the guest from 3:00 pm on the day of arrival.
2. Rooms must be vacated by 11:00 AM on the day of departure. If the room is vacated by 6:00 PM, 70% of the room rate will be charged unless otherwise agreed, and 100% will be charged for vacated rooms after 6:00 PM.
3. Unless a later arrival time has been expressly agreed upon, the hotel reserves the right to reassign booked hotel rooms from 6:00 pm onwards.

IV. Services, Prices, Payments, Offsetting

1. The guest acquires no right to the provision of specific rooms or premises. Should the agreed-upon premises not be available, the owner of the Alte Schlossbrauerei is entitled and obligated to endeavor to provide at least equivalent alternative accommodation within the establishment or in other properties.
2. The hotel's catering service generally ends with breakfast on the day of the customer's departure.
3. Reimbursement for paid but unused services is excluded.
4. Prices are determined according to the price list valid at the time of contract conclusion, unless otherwise agreed. If the period between contract conclusion and service provision exceeds four months, the owner reserves the right to unilaterally implement price changes without prior notice, provided these are objectively justified and reasonable in the individual case.
5. All prices are inclusive and include service charge and statutory VAT. If the statutory VAT rate changes after the contract is concluded, the agreed price will change accordingly.
6. Hotel invoices without a due date are payable immediately upon receipt without deduction. The owner of the Alte Schlossbrauerei (Old Castle Brewery) is entitled to demand immediate payment of any outstanding amounts at any time. In case of late payment, the owner of the Alte Schlossbrauerei is entitled to charge interest at a rate of 4% above the respective discount rate of the German Federal Bank.
7. A reasonable advance payment may be required for reservations and events at any time. Failure to provide the required advance payment on time entitles the owner of the Alte Schlossbrauerei to withdraw from the contract after its conclusion.

V. Customer's withdrawal (cancellation, cancellation)

1. Any cancellation by the customer of a contract concluded with the owner of the Alte Schlossbrauerei (Old Castle Brewery) must be submitted in writing to the Alte Schlossbrauerei and requires the owner's consent. If such consent is not given, the agreed price under the contract is payable even if the customer does not make use of the contractual services. This does not apply in cases of default by the Alte Schlossbrauerei or if performance becomes impossible due to circumstances for which the Alte Schlossbrauerei is responsible.
2. If a deadline for cancellation of the contract has been agreed upon in writing between the owner of the Alte Schlossbrauerei (Old Castle Brewery) and the customer, the customer may cancel the contract up to that deadline without incurring any payment or damage claims from the owner of the Alte Schlossbrauerei. The customer's right of cancellation expires if they do not exercise their right to cancel in writing to the owner of the Alte Schlossbrauerei by the agreed deadline, unless the Alte Schlossbrauerei is in default of performance or performance is impossible due to circumstances for which the owner is responsible.

In all other cases, the following rules apply:
-Cancellations between 30 and 15 days inclusive before the provision of the respective services: 40% of the ordered / reserved services will be charged.
-Cancellation between the 14th and 8th day inclusive before the provision of the respective services: 60% of the ordered / reserved services will be charged.
-Cancellation between the 7th and 3rd day inclusive before the provision of the respective services: 80% of the ordered / reserved services will be charged.
-Cancellations within 48 hours before the provision of the respective services: 100% of the ordered / reserved services will be charged.

Cancellation fees will be reduced by any amounts received from re-letting the cancelled rooms or from re-billing the services for the booked/reserved date by the Alte Schlossbrauerei. The aforementioned cancellation fees also apply if the booked/reserved services are only partially cancelled by the guest, in which case the stated flat rates refer to the portion of the services that was cancelled, or if the guest does not use the booked/reserved services without explicitly cancelling.
4. For rooms not used by customers, the owner of the Alte Schlossbrauerei must take into account the income from renting the rooms to other parties as well as the expenses saved.
5. If rooms are booked in connection with an event (e.g., Easter, Christmas, New Year's Eve...), the owner of the Alte Schlossbrauerei charges a flat-rate cancellation fee of 50% of the agreed package price for cancellations up to 31 days before arrival. For cancellations less than 31 days before arrival, the cancellation fee is 80% of the contractually agreed package price.
6. Group bookings of 10 people or more: If a group booking is completely cancelled, the percentage rates mentioned under V. / 2. will each increase by 10%. If the reservation includes more than 80 overnight stays, the deadlines will each be extended by 30 days.
7. The following cancellation deadlines apply to a scheduled event and the provision of premises:

-over 30 days: Provisioning fee is waived
-29th - 15th day: Calculation of provision costs
Days 14-8: Calculation of setup costs plus compensation of 33% of lost revenue (food); if this has not yet been specifically determined, the following applies:
Minimum menu price for banquet x number of people, plus 100% of third-party services.
-7. - 3rd day: Calculation of the provision costs plus 66% of the lost revenue (food); if this has not yet been specifically determined, the following applies:
Minimum menu price for banquet x number of people, plus 100% of third-party services.

VI. Other

1. Animals are allowed generally not can be brought into the hotel / restaurant (indoor area) and the themed dining experience.
2. The hotel will carry out wake-up calls with the utmost care. Claims for damages arising from faulty performance are excluded.
3. Information is provided to the best of our knowledge. Claims for damages are also excluded here.
4. Lost and found items will only be forwarded upon request. They will be handed over to the local lost and found office at the owner's discretion.

VII. Final Provisions

1. The invalidity of individual provisions of the contract or these terms and conditions does not affect the validity of the remaining provisions or conditions.
2. For all disputes between the customer and the owner of the Alte Schlossbrauerei, the court at the place of business of the company Alte Schlossbrauerei is agreed as the place of jurisdiction, insofar as legally permissible.
3. The law of the Federal Republic of Germany applies.
